Terms of Service

1. Agreement

By creating an account or using tapedeck you agree to these terms and to our Privacy Policy. The provider is Burzinski & Jaenisch GbR, Burgunder Str. 1, 14197 Berlin, Germany, as identified in the Imprint.

If you use tapedeck on behalf of an organization, you confirm that you have authority to bind that organization.

2. The service

tapedeck lets you store unfinished and unreleased music, organize it into projects, invite specific people, and collect timestamped comments. Uploads are private by default. We do not operate a public catalog, radio, or discovery feed of other people’s music.

We may change features, capacity, or availability as the product evolves. We will not use that to take rights in your music beyond what these terms already grant.

3. Accounts

You must be at least 16 years old. Keep your sign-in method under your control. You are responsible for activity on your account.

You may sign in with Sign in with Apple, Google, or email. On the web we also offer passwordless one-time codes. Do not share access credentials or session tokens.

4. Your content and copyright

You retain the rights in music, artwork, comments, and other material you upload (“your content”). You grant us a limited license to host, store, transcode, cache, and transmit that content solely to operate the service for you and for people you authorize — including creating playback derivatives and generating short-lived signed URLs.

You represent that:

• you own the content or have all rights needed to upload and share it here;
• the content does not infringe copyright, neighboring rights, trademarks, or privacy rights of others;
• sharing it through tapedeck will not violate a label, publisher, or other agreement you are bound by.

We do not claim ownership of your unreleased music. We do not sell it or license it to the public.

5. Prohibited content and conduct

You may not use tapedeck to upload or share:

• content you do not have the right to distribute;
• illegal content, including child sexual abuse material, terrorist content, or content that incites violence;
• malware, or material intended to harass, threaten, or dox others;
• spam, scams, or attempts to probe, overload, or circumvent access controls.

Do not attempt to access another person’s private library, signed media URLs, or accounts. Do not scrape or republish private audio.

6. Sharing, invitations, and comments

When you invite someone or create a share link, you decide who can listen, comment, or download. You are responsible for choosing recipients who are allowed to receive that material.

Comments, reactions, and notes are user-generated content visible to people with access to that project or track. Treat them as part of a private working conversation, not a public forum.

7. Reporting, blocking, and enforcement

You can report another person’s comment and block their account from in-app controls. We review reports and may remove content, restrict features, or close an account that violates these terms or the law. We may do so without prior notice when needed to protect people, rights, or the service.

8. Subscriptions and payments

A free plan is available with stated limits. Paid Artist and Artist Plus plans unlock additional capacity and features described at purchase.

App Store and Google Play

Purchases in the iOS app use Apple In-App Purchase. Apple’s Licensed Application End User License Agreement applies to the iOS app in addition to these terms. Subscriptions billed by Apple automatically renew unless you cancel at least 24 hours before the current period ends. Manage or cancel in Settings → Apple ID → Subscriptions. We do not receive your payment-card details.

Purchases in the Android app use Google Play Billing and are managed in Google Play subscription settings.

Web

Purchases on the website are processed by our billing provider and Stripe. Deleting your tapedeck account does not by itself cancel a store or Stripe subscription; you must cancel it where you bought it.

9. Termination and account deletion

You may stop using tapedeck at any time and delete your account in Settings. We then remove your library, uploads, comments, shares, and profile as described in the Privacy Policy, subject to legal retention duties and a short storage-cleanup delay.

We may suspend or delete an account that violates these terms, creates legal risk, or remains unpaid after a paid plan lapses where continued use requires payment.

10. Disclaimers and liability

We provide tapedeck with reasonable care but cannot guarantee uninterrupted availability or that transcoding, playback, or notifications will always succeed. Keep copies of masters that matter to you.

We are liable without limitation for intent, gross negligence, injury to life, body, or health, and for claims under the German Product Liability Act. For slight negligence we are liable only for breach of essential contractual duties, and then only for typical, foreseeable damage. Otherwise liability is excluded to the extent permitted by law. These limits apply to the same extent for our legal representatives and vicarious agents.

11. Governing law and changes

German law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer in the EU, you also keep mandatory protections of your country of residence. The courts of Berlin have jurisdiction to the extent a venue agreement is allowed.

We may update these terms when the product or the law changes. The version on this page is the current one. Material changes will be announced in the product or by email where we can reach you. Questions: info@bejanic.de.
